If Pasadena TX resident Joe Horn had known what was going to happen on the afternoon of November 14, 2007, he likely would have preferred to stay in bed. By the end of the day, the then-61 year old Joe would find himself at the center of a storm of polarized public opinion, accusations of racism, and debate over the merits Castle Law.

His act of confronting two men (career criminals from from Colombia who had entered the country illegally after one had already been deported, and were members of an organized burglary ring in Houston) he caught in the act of robbing his neighbor's home - and then heading for his own house - would be the first real test of the newly-passed Texas Penal Code § 9.41., § 9.42., and § 9.43. On the 911 tape, he is heard confronting the suspects, saying, "Move, and you're dead."

They failed to heed the advice of the elderly man with the shotgun, and were both shot dead as a result.
